Dick, and all,

This used to be true, but the rules now state in Section 8 - Miscellaneous

(b) No cross-mode contacts.  Both stations must be using the same mode of
transmission.  Also, CW contacts must be made in the CW portions of the
band.


So you do have to go to the CW only subband to work the station on CW.
